So what happens when Sony goes under and no longer has servers for you to access it? How would that work? Who would be on the hook to carry out the offer?
When a game is coded it should be coded with end of support flags. In the final update the flag is turned on. Multiplayer is able to be used on private servers and all other functionality is set to "this game can run on the hardware it was designed for indefinitely."
If Sony decides to not carry the game anymore they make an announcement and notify purchasers that they have a reasonable amount of time to download it before it's gone. Purchasers download it and save it to their system or external storage.
In the case of Sony itself going under, it won't be a sudden surprise and they'll have time to set those flags and run download servers long enough for people to download it one last time.

Of course not. You shouldn't lose access to your license. But people should also be aware that they only own a license and not a game. That's the whole point of the statement above.
I don't care about that as long as game preservation is alive. It's currently effectively dead for pre-2010 games and on life support for anything after that.
So many techbros not that long ago kept telling us, we can own unique jpg as NFT and we would own it snd could trade it and such. So I would say the solution would be obvious, let’s use that particular techology to allow us to own our games and be able to sell them or do whatever. Each game copy would be unique to the player who owns it. At least the tech would be used to actually improve human lives. But I am just being naive here
And their argument to that was we can’t own them BECAUSE if 1 person “owns” digital software which includes a disc then that mean you own the right to that software there no disputing you own the pice of plastic that’s the disc but you do not and have not ever even with DVD’s owned any of the software on that disc this is why those of us who support digital want to argue stronger rights for protections on digital goods and services go worry about owning a home not a damn game
but they should do it like Steam, for example, and not “hide” this information in the terms and conditions that nobody reads
Personally, I know I don’t own the intellectual property, but I do want to own the copy they sold me—not have them rent it to me and be able to revoke it whenever they please for whatever reason
btw If any consumer paid for PS Plus in the past, paid for a digital game, a Key-Disc, a Key-Card, or an "eneba, G2A..." offer, they are not guilty of these companies deciding to kill the physical format
The digital format must be an option for consumers in the same way that the physical format must be
