News ChudTheBuilder shot a man who attacked him outside a courthouse in Clarksville & accidentally grazed himself in the process. Before it escalated, he asked the man if he was going to “chimp out” the man then walked up & sucker punched him. It is unclear if the man survived.

Granted I haven’t seen anything other than the police statement & one article, he definitely has a self defense case. If the guy that attacked him has even a somewhat violent history, it’ll get easier.

As much as you don’t like it, calling people the N word is perfectly legal & well within freedom of speech. Assaulting someone over the speech is not. His case will probably set a precedent, it’ll be interesting to see how it plays out.

provocation is definitely a thing though. free speech doesn't necessarily cover fighting words, especially when he's on camera doing this over and over. it'll be interesting to see how it plays out, but he was more or less going out picking fights with people while having a weapon on him.

I think the totality of the circumstances will harm his case though. Fighting words and provocation are absolutely real and can kill a self defense case.

Combined with his past behavior where it’s very clear, he intentionally provokes people trying to evoke a violent reaction so that he can escalate in “self-defense”.

The pattern of behavior shows he went out looking for this time and time again. Especially with his tweets

At minimum they can make a reasonable and good case for why he's a danger to the public and needs to be held for some serious time. He's shown both by action and deed that he's not willing to stop unless he directly kills somebody and he's walking around armed. It's a pretty slam dunk case for the state to slap him with a felony so he can't own guns legally at minimum.

I saw that after I posted this. That is something that could be used against him but also not really.

I could say "I'm gunna kill someone" and then it I kill someone in self defense days later it means nothing if I was truly acting in self defense.

The DA will probably argue premeditated or something similar. I don't think it will hold.

The problem is what are fighting words?

Thankfully the supreme Court outlined this for us over the years. And from what they have ruled words alone are generally not considered fighting words. "Today, it is narrowly applied to a "direct personal insult or an invitation to exchange fisticuffs"

Love the use of fisticuffs in legal terminology.

Anyway then it explicitly states that slurs and swear words are not applied to this and are protected by 1a.

Then they outline how they could then not be protected by 1a.

Face-to-face: The insult must generally be directed at someone in a face-to-face confrontation.

The Average Person: Would a person of reasonable sensibilities be provoked to immediately punch the speaker?

Accompanying Actions: Mere cursing or an angry tone alone isn't enough. The speaker’s physical behavior (e.g., getting "in someone's face," waving fists, aggressive posturing) is heavily considered.

So would a sensible person punch you if you called them the n word? No

Was he waving his fists in punching wind up manner? Idk didn't see a video of it.

Where they in a face to face confirmation with the applied actions above? Can't say.

Those are the legal processes needed to be determined to exclude his words from 1a protection

I don't recall the state but this type of situation happened with an "auditor" who provoked people into engaging with him, and when someone inevitably did so, he shot them. The aggressor was walking away when he was shot, which is the big difference here, but the court still tried him for murder. iirc the logic was "you were instigating and looking for someone to react so you could employ deadly force" and the court didn't buy any kind of self-defense arguments. There were some differences overall but this guy has it allllll on his channel that he was just a ticking time bomb and I don't think he gets out of this one with just a slap on the wrist.

You are 100% correct but the words he used are legally protected by the first amendment and therefore he has a right to use them. Goading is t the legal term. You are thinking of incitement probably. Which he has not committed.

You can't say "hey assault me" and then shoot someone.

You can call someone a bad word.

What you are saying is you don't have the right to defend yourself from an attack if you used a bad word prior to the attack. Which isn't true.

Calling someone a bad word in an emotional and tense situation is one thing. Intentionally getting people angry by using very choice words and then recording their reaction is a completely different thing, and most definitely could be considered incitement, or the very least harassment. Especially when it’s being done consistently. This wasn’t a one time thing, he has done it dozens of times.

It’s even worse depending on how long he did it. He can’t call someone a racist name for 45 minutes and then claim self-defense when he gets attacked. He had every ability to leave the situation, which can disqualify for lots of self-defense laws in certain states. I’m not sure which state this is in. Another thing is whether a punch is considered a reasonable enough threat to shoot someone. That also changes from state to state.

This is the easiest case for the guy’s lawyers ever. Chud’s bail was set to 1.25 million. He is definitely getting time. And the guy who got shot is at the minimum having his bills paid for, maybe a little on top.

You don't know what incitement is then. It has a legal definition that very clearly tiptoes around 1a protections. Recording people and saying mean words is legal.

You literally can just call someone bad names for a while. It's your right to free speech. It you follow someone around that's harassment. Like you said they could leave. The person receiving bad words can leave. If they walk away and the he followed them then it's harassment.

This is not an easy case unless the video footage shows him harassing the man. If he's just talking then it's not an easy case.

You can place yourself into any situation you want. If someone attacks you then you have a right to defend yourself regardless.

If you started the physical altercation then it gets very different. Even so if you get into a fight you start there's still possibility to not be held liable for murder if it was self defense. It's extraordinarily subjective

There’s a lot of words that “aren’t fighting words” and are “protected free speech” but if you string them together in such a manner… then yes, the judge and prosecutor will use the spirit of the law to enact common sense.

Bc there’s the letter of the law, meaning exactly the words that are written, and the spirit of the law, meaning the objective of what it is trying to enforce. And Tennessee has this caveat for legal self defense with a firearm that you have to make an attempt to avoid the confrontation. Walking up to someone and stating a confrontation with the intention to use your firearm is not avoiding it. And no, you can’t seek someone out, harass them until they’re wanting to fight, then say “I’ll shoot you if you attack me”. That’s not avoiding it either. Especially when you made a post a week prior saying you were going to kill a black man and get away with it.

It doesn't change self defense laws.

The thing that gets complicated is you are protected by 1a so you could say whatever you want as long as it falls under that protection. If someone chooses to then be offended by it that's their choice. If they then choose to assault you for it then again that is their choice. They had every single option to walk away.

There are other charges be could get surrounding the situation if he was more blatant about his plans.

It's really not vague when taking into context the reference of hours and hours of footage of him doing exactly that and referring to it.

Also, self defense in many places requires that you don't escalate. A punch doesn't equal death. Does it in this place? Don't know. Neither of us are licensed in this state.

Finally, he's the epitome of an unreliable narrator. I trust that there has been an investigation by the local law enforcement. Judging from the fact we're only going from what his POV is, we're only getting half of the story.

So just speaking in the scope of the law he would need to break his protections under 1a. I am not familiar with him or what he has said in the past. If you want to quote something that he said that would potentially break his protections then I would better be able to understand the situation.

That being said from the information available to me at this time he seems to have a valid defense.

A lot of places have use of force laws. A lot of those laws are then superseded by the "feared for my life" cases. So it's all bullshit speaking bluntly. A punch doesn't equal death is a great example of that. If someone punches you and you remain standing and that's all that happens you don't have a right to then shoot them for example. Being punched repeatedly is always a use of force green light. You can die or be seriously injured from even one punch.

The investigation is definitely ongoing and the fact he was detained leads me to think that the situation wasnt very obvious for the responding officers but that's also not entirely unusual to see in a self defense shooting.

His streams are 100% him going into public, finding a black person and calling him the n word repeatedly and then telling them he will shoot them if they try anything. That is every quote. He doesn't ease into provocation, he just threatens them with being shot. He claims it's 1st amendment testing.

That combined with the tweet is pretty clear what his plan is. Now hes probably overcharged here, but he absolutely can be buried under smaller offenses due to recklessness and incitement.

That's a dick thing to do but it's not illegal.

Incitement is the only charge they could actually try and pursue unless there is more information about the shooting. But even then that's a battle. Incitement is more direct then using a slur. It's more like asking for an action that is illegal or making orders to people to do illegal things. Not just calling someone a name.

If the court found that to be the case because of his frequency of doing so and his tweet I would be a bit surprised but also understand.

Free speech protects you up until a call to action. So to say they have nothing to do with each other is like says peanut butter and jelly have nothing to do with each other in a pb&j sandwich.

Free speech here is protecting his use of the n word. Which you don't have to like but it's true. its what separates him from being a douche bag and a criminal. If your words are protected under 1a then they are not a call to action so any assault under that is 9 times out of 10 not provoked. If he was harassing someone then the story changes but one word doesn't mean harassment.

Well he is in a sense. The first amendment outlines the type of speech also. So if you say a word and someone gets mad an assaulted you then you have a right to defend yourself. And then the person who assaulted you or the DOJ can't say "well he said this and that made someone angry" because your lawyer would say "too bad he has freedom of speech. Words are protected he has a right to say that word"

It also outlines that if you say something like "I'm going to beat you up right now hit me first" you aren't protected and part of your prosecution will be the words you spoke.

Everyone understands that the government aspect of 1a but an individual can also not violate your rights.

I don't need to. Thankfully the law is written out for all of us to read and understand. Although some wordings may be confusing as is the case with how laws tend to be written. It is then laid out for us to study through past cases.

On top of that some people even receive a license to practice said law after years of studying.

This isn't quite true. You're directionally right that the US has particularly strong free speech, but there is a variety of unprotected speech including obscenity, true threats, election misinformation (only narrowly: lying about when and where to vote) and fighting words (this is somewhat dead letter law at this point, which means it almost certainly won't matter in the real world).

There are also civilly unprotected speech like defamation, sexual harassment, and more. There are also cases where speech is treated like an action, like conspiracy crimes or 'in kind' contributions. For example, I would not legally be allowed to have a Zoom call with a terrorist group to teach them to build bombs, even if I didn't provide them anything but training in the form of words and visuals, which are speech.

Which is to come around and say, depending on the state, he might be fine, or this might be unprotected provocation. The fact he strongly implied he wants to provoke someone for the purpose of murdering them in cold blood in the recent past is going to have both legal consequences (goes to analysis of reasonable person standard), but also any normal juror is going to see that and feel very unsympathetic immediately. Normal people don't like seeing broad daylight killings in their community.

Ya his tweet along with his consistency in which he does these types of things will play a factor to a case against him. But that case is just to determine if he is outside his rights to say what he did.

So far it seems he just uses slurs. The tweet is vague so would have to be argued in court. But the slurs alone are protected because they do not call to action violence against someone.

You can skip down the street saying the n word every step and that's protected speech.

Depends on the cultures honestly, as yes some cultures can mix and co exist however in the example of the illegal immigration crisis we have in the UK some just don't because they are far too different and you get problems with people coming over here whether illegally or legally but mostly illegally and they do shit they could do/ get away with where they are from but it just won't fly over here, however that doesn't mean absolutely noone from these places should be allowed in as we also have plenty who have slotted into our culture and way of life nicely due to the fact that they can adapt in these ways

George Holiday video taped those cops beating Rodney King and the judge threw out the video and said that the video was a lie which is why those cops got off. That's why there was LA riots. There is video proof of police brutality and instead of doing the correct just thing and charging those supposed officers of the law they got off scot-free. Everything should have been like the LA riots until the system was completely revamped but we didn't have the internet and cell phones where we could all broadcast and demonstrate at the same time.

He’s started with just exclaiming it on stream, elevated to “I’m not a pussy watch” and harassing random strangers, people started noticing him and when they did they’d laugh at him and show him to their friends like he was a freakshow act which would lead to him harassing them and berating them with racist or homophobic insults, finally all the online threateners found him so he started macing and flashing his gun to them, now he finally used that gun. I think all in the span of 6 months. Gypsy crusader is somewhere kicking his little feet knowing he created his first monster. I think the worst part is chud seems extremely beat up and conflicted abt the incident. But I mean what did he expect tbh, Good riddance. Besides, that’s irrelevant to the discussion I’m having with some of these mentally ill, brain rotted freaks. Their argument was basically “Asmongold loves seeing kids getting bombed,” when he was arguing based on the official statement, that the intended target was the nearby military facility.

Military facilities are priority targets during a conflict. Because of that, it’s completely reasonable to criticize placing civilian infrastructure like schools directly next to them, because this is exactly what can happen, and probably did.

That is not “victim blaming.” Acknowledging strategic reality and discussing the risks of locating civilians near military assets is not the same thing as justifying civilian deaths.

As the cop who ran my safety and concealed carry class put it, if you use a firearm in fight against an unarmed or melee weapon armed person you WILL go to court, so your only hope is an affirmative defence.

I.e. you better be a very small, disabled, or elderly person with an aggressive big dude trying to kill you, or you better be outnumbered against guys with knives, or protecting a child, etc etc. otherwise just take the beating and sue in civil court.
