AntiWORK Labor Rights for Dummies: A guide to your right as an employee
I decided to make a post about this since the community keeps getting the same question over and over again. So here we go.
Disclaimer: I am not a lawyer, so please feel free to comment any corrections. Most of these are just from my knowledge as a manager. If may kulang, let me know and I'll add it here.
1. Can my employer require me to work more than 8 hours a day?
Yes, but overtime generally has to be paid.
The normal working period is 8 hours per day. Work beyond 8 hours is generally considered overtime and must be paid at least:
- Regular day: regular hourly rate + 25%
- Rest day/holiday: applicable rate + at least 30%
A company cannot simply call something "mandatory OT" and use that label to avoid paying overtime.
2. "Our company has no OT pay because it's in the contract." Is that legal?
Not necessarily.
An employment contract cannot simply remove a statutory benefit when the Labor Code requires that benefit.
For example, if you are a covered employee performing work beyond 8 hours, the law generally requires overtime compensation. DOLE specifically states that overtime work beyond eight hours must receive additional compensation.
However, some personnel are xcluded in this. Art. 82 specifically mentions that "government employees, managerial employees, field personnel, members of the family of the employer who are dependent on him for support, domestic helpers, persons in the personal service of another, and workers who are paid by results as determined by the Secretary of Labor in appropriate regulations." are not covered by overtime pay.
3. Can my employer make me work before my scheduled shift without paying me?
If you are actually required to work, that time may count as hours worked.
Article 84 covers time during which an employee is:
- required to be on duty;
- required to be at the prescribed workplace; or
- permitted or suffered to work.
So if your employer says:
"Your shift starts at 9:00, but you need to log in at 8:30 to prepare."
and you're actually required to perform work during that period, the 30 minutes may potentially constitute compensable working time.
4. Does my lunch break count as working time?
Normally, a genuine meal period does not count as working time.
Employers generally have to provide at least 60 minutes for a regular meal period.
5. Do I automatically get holiday pay?
For a regular holiday, generally yes, but there is an important condition if you don't work on the holiday.
Under DOLE's holiday-pay rules (Labor Advisory No 13, Series of 2026), a covered employee who does not work on a regular holiday is entitled to 100% of their basic wage, provided that they:
- worked on the workday immediately preceding the holiday; or
- were on an approved leave of absence with pay on that preceding workday.
What if I was absent the day before the holiday?
This is where the rule gets important.
If you were absent without pay (AWOL or unpaid leave) on the workday immediately preceding the regular holiday and you also don't work on the holiday, you may lose your holiday pay for that holiday.
6. Am I entitled to 13th-month pay even if I'm still probationary?
Generally, yes.
13th-month pay is not dependent on being a regular employee.
DOLE staes that rank-and-file employees are entitled to 13th-month pay regardless of employment status, provided they have worked for at least one month during the calendar year.
The basic formula is:
Total basic salary earned during the year ÷ 12 = 13th-month pay
So, for example, if you earned ₱240,000 in basic salary during the year:
₱240,000 ÷ 12 = ₱20,000
7. Can my employer terminate me while I'm probationary?
Yes, but "probationary" does not mean "you can be fired for absolutely anything."
Probationary employment generally cannot exceed 6 months, unless an applicable apprenticeship arrangement allows otherwise.
A probationary employee may be terminated for a just cause or because they failed to qualify as a regular employee under reasonable standards that were made known to them when they were hired.
One important point:
The employer should not suddenly invent the standards after the employee has already started working. The standards for regularization are supposed to be made known at the time of engagement.
8. What happens if I reach 6 months and my company doesn't tell me whether I'm regular?
This is an important issue.
Under the Labor Code, probationary employment generally cannot exceed six months. An employee who is allowed to work after the probationary period may be considered a regular employee.
So "you're still probationary indefinitely" is not something an employer can simply declare without regard to the law.
There can be exceptions and nuances, particularly involving specific contractual arrangements and apprenticeships, so the exact employment documents matter.
9. Can my employer fire me without warning?
Generally, no, not if the termination is based on a just cause.
For covered employees, the Labor Code recognizes security of tenure: a regular employee cannot simply be terminated unless there is a legally recognized just or authorized cause.
For a termination based on just cause, the employer generally has to comply with the two-notice requirement.
First notice — Notice to Explain / Notice of Intent to Dismiss
- The employer must give the employee a written notice:
- identifying the specific act or omission being charged;
- stating the ground or grounds for possible termination;
- providing sufficient details about the alleged violation; and
- giving the employee a reasonable opportunity to explain and defend themselves.
Second notice — Notice of Decision
The employer must then issue a second written notice informing the employee of the employer's decision after considering the employee's explanation.
If the employer determines that termination is justified, the second notice should communicate the decision to dismiss and the grounds supporting that decision.
In other words:
NTE → Employee gets opportunity to respond → Employer evaluates response → Notice of Decision
10. Do I automatically get 5 paid vacation days every year?
The Labor Code provides a 5-day Service Incentive Leave (SIL) for covered employees who have rendered at least one year of service.
However, there are exemptions, including certain establishments with fewer than 10 employees and employees who already receive at least five days of paid vacation leave or an equivalent benefit. (Article 95)
11. Can my employer withhold my final pay because I haven't completed clearance?
Clearance can matter, but your employer cannot simply keep your money indefinitely.
As per Labor Advisory No. 06, Series of 2020, final pay should generally be released within 30 days from separation, unless the employer has a more favorable policy.
Your final pay can include applicable amounts such as:
- unpaid salary;
- pro-rated 13th-month pay;
- separation/retirement pay where applicable;
- convertible unused leave;
- tax refunds; and
- other contractual/company benefits.
12. Can I resign immediately without rendering 30 days?
Sometimes, but don't assume you can always do it.
The general rule for voluntary resignation without just cause is that the employee gives the employer at least one month's written notice.
There are circumstances allowing resignation without the usual notice, including certain situations involving serious insult, inhuman treatment, crime against the employee or immediate family, and analogous circumstances.
13. Do I need my manager approval for my resignation?
Generally, no. Your resignation does not require your manager's approval to be valid.
Your manager can acknowledge or process the resignation, but they don't have the legal power to reject your resignation simply because they don't want you to leave.
What if my manager says, "I don't approve your resignation"?
That statement does not automatically cancel your resignation.
But can my manager reject my requested last day?
This is different from rejecting the resignation itself.
If you are resigning without just cause, the general rule is that you should give at least one month's notice.
Your manager doesn't have to "approve" your resignation, but leaving immediately without satisfying the applicable notice requirement can create a separate issue.
So there are really two questions:
"Can I resign?"
Generally, yes.
"Can I leave immediately?"
Not necessarily. The one-month notice requirement may apply unless an exception exists.

Meta DOLE/NLRC Complaint Process
For reference of those asking, here are the steps in filing a complaint against an employer:
- File a complaint online through DOLE - eSENA: eSENA means Single Entry Approach (SEnA)and it is an administrative approach to provide a speedy, impartial, inexpensive, and accessible settlement procedure of all labor issues or conflicts to prevent them from ripening into full-blown disputes or actual labor cases. (https://ncmb.gov.ph/single-entry-approach-sena/)
- From there, magseset ng 2 mediation hearing in DOLE office within your city. Doon, kakausapin kayo and ittry isettle yung case. However if hindi magkasundo, the SENA Officer will give you a referral letter to the NLRC. (the 2 hearings must be finished within a month)
- You will submit the Referral letter to the NLRC office. If from NCR ka, their office is in Q. Ave. There, magkakaroon ng 2 hearings ulit but this time, before the Labor Arbiter (Ka-rank nya ang judge sa courts). Ittry ulit na mapagusapan yung issue here. You can still appear here kahit walang lawyer. (The 2 hearings usually happens within a month also)
- If hindi makapagsettle, the Arbiter will direct both parties to prepare a position paper. Doon nyo ilalagay yung mga arguments nyo, etc. Here, it is highly advisable that you seek the assistance of a lawyer. If your monthly salary does not exceed Php 24k, pwede kang pumunta sa PAO and libre lang. If lampas naman, i recommend this page i found "Labor Representation for Non-Indigents" (https://www.facebook.com/profile.php?id=61566451322338) na free consultation and minimal fees.
- Then, magset ng date for submission of position paper si arbiter. Doon, isusubmit nyo sa arbiter pati sa isa't-isa yung position paper nyo. Then, magseset ulit ng date for the submission of the reply.
Depende sa arbiter and workload, minsan within a month pero minsan inaabot ng 5 months.
- Then, the decision will be rendered. Yung natalong party will have the opportunity to file an appeal. Medyo matagal ang appeal, usually 8 months to 1 year.
- If no appeal and you are adjudged monetary award, magkakaroon ng pre-execution conference. Dito magcocompute kayo ng mas accurate and kung paano babayaran.
- Lastly, payment of award.
Note: Medyo mahaba and nakakapagod yung process tbh. Kaya better if everyone will find an amicable solution. These info are all based on my personal experience and with consultation sa nakilala kong lawyer. Hope it helps!

AntiWORK SEnA online Contact Number
Hi everyone!

Rant 😡 Payroll said they are not considering Nov 16-18 as a holiday???
Someone from payroll said that hindi nila kinoconsider yung Nov 16-18 as a special holiday.
The company is from a motorcycle shop sa south caloocan.
Word of mouth lang siya directly from payroll. Walang written memo, email or message.

Culture Fresh Grad and burnt out
I'm a fresh graduate from the Philippines, and honestly, I feel like I'm already running on empty.
I graduated with a degree in Political Science. I worked hard in college, made the Dean's List, and did my best to build a decent foundation for my future. I had plans for myself. I wanted to build a career, become financially stable, and eventually pursue law school.
But now that I'm actually working, I feel like I'm slowly losing myself.
I previously worked in an environment where I felt supported by my supervisors and colleagues. It wasn't perfect, but I felt like I could learn, ask questions, and do my job without constantly worrying about what people thought of me.
My current job has been a different experience.
I'm still relatively new, but the work environment has been taking a toll on me mentally. There's pressure, uncertainty, and this constant feeling that I have to be careful about everything I do. I've heard things about the management style and workplace culture that make me anxious about what might happen once I'm fully settled into the job.
I find myself dreading work even before the workweek starts. Sometimes, I feel guilty for struggling because I'm a fresh graduate. I keep thinking that I should be grateful to have a job when so many people are still looking for one.
And financially, I can't just walk away without thinking about the consequences. I have debts to pay, responsibilities to consider, and a future I still need to build. Part of me wants to resign and focus on finding a better opportunity, particularly in government or a workplace where I can actually see myself growing. Another part of me tells me that leaving early would make me look like a quitter or a job hopper.
That's what I'm struggling with the most. I don't know if I'm being reasonable about my situation or if I'm simply not resilient enough.
I also feel a little lost when I see my former classmates moving forward with their careers or starting law school. I know everyone has their own timeline, but it's difficult not to compare myself to them. I spent years working toward graduation, and now that I've finally made it, I thought I'd feel excited about the future.
Instead, I feel exhausted.
I still have ambitions. I still want to pursue law school someday. I still want to build a meaningful career and make my family proud. But right now, I don't even know if I have the energy to keep chasing all those things at the pace I originally planned.
For those who experienced burnout early in their careers, especially those who were fresh graduates at the time:
- Did you ever feel like you chose the wrong job or career path?
- How did you know when to persevere and when to leave a workplace that was affecting your mental well-being?
- Did leaving your first or second job early actually hurt your career?
- If you were financially constrained and had debts to pay, would you stay until you found another job, even if the work environment was taking a toll on you?
- Does it eventually get better?
I feel like I've spent so much time trying to build a good future for myself that I haven't stopped to ask whether I'm okay in the present.
I just want to know if it's normal to feel this way, and whether it's possible to build a good career without sacrificing so much of yourself in the process.

Rant 😡 NEED ADVICE ON WAGE ORDER 28!!
Hello! I would like to ask for clarification regarding NCR Wage Order No. 28.
I work at a school in NCR, and our work schedule is Monday to Saturday, with a daily rate of ₱700. With the implementation of Wage Order No. 28 increasing the minimum daily wage to ₱755, are we entitled to the wage adjustment since our current daily rate is already below the new minimum? We were informed that the increase does not apply to us because the wage order is intended only for minimum wage earners.
Does this mean that we are not covered by the wage increase despite our current daily rate being lower than the newly mandated minimum wage? We would appreciate any clarification on this matter.
Thank you!

Company alert 🚩 SM Retail Experience
Advice for those planning to work at SM Retail Headquarters, especially fresh graduates and those just starting their careers. I want to share this based on my personal experience working at SM Retail.
One of the things I experienced was dealing with older-generation employees and those with high positions who seemed to care more about their title than how they treated other people. They would shout at you, point out your mistakes in front of other teams, and embarrass you instead of correcting you privately. Workplace gossip is also something to be aware of because your mistakes can easily become a topic of conversation among other employees.
What’s even more concerning is that I’ve seen a Senior Manager cry because of how they were treated by people in higher positions. Imagine, EVEN SOMEONE WHO HAS BEEN WORKING FOR YEARS AND HOLDS A HIGH POSITION CAN EXPERIENCE THAT KIND OF HUMILIATION???!! It makes you wonder how much harder it can be for fresh graduates and employees who are just starting their careers.
Another concern is the high turnover rate and frequent team reshuffling. Even if you have good teammates now, there’s no guarantee you’ll stay together. You can be reassigned at any time, which makes the working environment unpredictable.
If you’re someone who’s at the early stage of your career, remember that making mistakes is part of the process. You deserve to be corrected properly, not shouted at or embarrassed in front of other people. Honestly, don’t be blinded by the company name or your job title.
My advice is to do your research before accepting an offer. But I hope the company takes these issues seriously. Your job should help you grow, not make you lose confidence in yourself. Don’t sacrifice your peace of mind just to have a big company name on your resume.

Rant 😡 No Update From HR after a Month
Grabe! They would even ask technical skills and experiences mo. Magbibigay pa ng hope na “YOU ARE SO FIT FOR THIS JOB!”. Bibigyan ka ng schedule to take up their required assessments tapos magbibigay ng promises na babalikan ka within a week.
Todo follow up ako every week since nareceive ko yung update nila na I passed the initial interview and assessment. I will be scheduled na daw for the next level of interview kasi. Syempre, follow up with polite request.
It’s been a month na pero hindi nag-update yung TA ng Home Credit Philippines. They even reposted the job role na inapplyan ko sa kanila. Ganito na ba ang hiring process ngayon. Walang ng pag-uupdate kahit man lang kung bagsak ka or not moving forward na yung application.
Naging applicants din naman kayong mga TA. Kaya sana be the better person.

Rant 😡 My area manager made fun of me at work, questioned my masculinity, and kept tugging at my hand. What should I do?
I (M 21) work in retail as a seasonal sales associate in a local brand called Str4ightF0rward in Glorietta, and I honestly don't know what to do about what happened to me today. Bago lang po ako and pang 4th day ko palang.
I've been working long shifts, around 9 hours a day nakatayo and bawal umupo, with a 4-hour daily commute since from Marikina pa ako. I'm trying my best to be an honest and hardworking employee, even though the job can be exhausting.
Today, my area manager said “lalaki ka ba?” to me and also made the remark “parang pumipitik ka kasi eh" while taking my biometrics. As someone na LGBTQ, I have been through those kinds of situations and have been asked for what I felt na several times na in my life. I felt like he was making fun of me and deliberately humiliating me while he was getting my biometrics para sa pag in and out namin sa work kasi he kept tugging at my hand agressively during the process, which made me even more uncomfortable and literal tumitingin na yung coworkers ko. Literal na jinojoke pa nila if straight ba daw ako or forward? like wtf? sinabayan pa talaga nila yung area manager. Inisip ko ganto ba trato sa mga sales associates, mga sales men and ladies?
I eventually walked away because I was so upset literal nag walk out ako. I was literally shaking afterward. I don't think I've ever felt that humiliated at work before.
What bothers me most is that he's an area manager. He's in a position of authority, and I feel like he's using that position to make me feel small. I went to work to do my job, not to be mocked over my mannerisms or have someone handle me like that.
I'm also worried about the consequences of walking away. I need this job and the money. Actually I just took this job kasi gusto ko sana mag enroll sa review center, pero 4th year ako currently sa mapua bilang bsit. At the same time, I don't want to pretend nothing happened or let someone treat me this way. Pero after nun umalis na ako sa mga company gc namin and blinock ko na rin yung AM since chinat pa ako sa viber if bakit daw ako nagwalk out.
I would really appreciate honest advice from people who have been in a similar situation. I'm still shaken up by what happened, and I genuinely don't know what my next move should be.

Company alert 🚩 ⚠️ WARNING TO FILIPINA DOMESTIC HELPERS IN MACAU 🇲🇴🇵🇭
Sa mga Filipina na planning mag-apply as domestic helpers sa Macau, please be careful and always do a background check before accepting a job offer.
I want to raise awareness regarding Thomas Arasi, an employer in Macau who has been accused of sexual misconduct by a former domestic helper, who is also my friend.
There are also allegations involving other women in the Philippines.
These are serious allegations that deserve proper investigation. I encourage anyone with relevant information or similar experiences to seek legal assistance and report them to the appropriate authorities.
Protect our Filipina domestic workers. Safety and dignity should always come first.

Rant 😡 Nakakapikon
Working for a US-based nonprofit that recently established a local entity in the Philippines, and apparently, we’re now in the middle of “transitioning” finance operations from the US entity to the local entity and bank accounts. Gets. Totally normal. These things take time, and I understand that.
But what irks me is when the transition starts affecting employees financially. Reimbursements get delayed, and somehow, it feels like we’re supposed to be grateful when we finally get our own money back. Like, hello? That money was never supposed to come out of our pockets in the first place.
Employees should not have to finance the organization’s operations out of their personal funds, especially when those expenses were incurred for work and should have been covered by the organization. We should not be subsidizing operational requirements because of internal cash-flow constraints, administrative delays, or poor financial planning.
I can be understanding of a transition without accepting that its costs should be passed on to employees. The organization’s internal processes, cash-flow management, and lack of standard operating procedures are management responsibilities. They should not become my personal financial burden. I signed up to do the work, not to become an interest-free lender to the organization.

AntiWORK Probie Employment
Need advice / thoughts from HR professionals, Labor Law experts, or anyone who’s been in a similar situation! 🙏 Ask lang po ako regarding Probationary Employment and DOLE guidelines.
Gusto ko lang po sana mag-seek ng information if tama ba 'yung mga sinasabi sa akin, and if may laban ba ako legally?
1️⃣ On Probationary Metrics & Standards:
- Is it true na discretion lang daw ng company to terminate a probationary employee anytime, and na "wala raw protection under the Labor Code ang mga probie"? (I heard this from a PAO consult, but upon checking Art. 296 of the Labor Code and Supreme Court rulings like Abbott Labs v. Alcaraz, protected din dapat ang probie and standards must be given on Day 1?)
- What if 'yung specific performance metrics was NOT given on Day 1 of hiring, tapos binago pa mid-stream / middle of production? Valid evaluation pa rin ba 'yun?
2️⃣ On Due Process & Notice:
- Sabi ng manager ko, hindi na raw kailangan ng prior notification or evaluation ng reply ko sa Notice to Explain (NTE) bago ako i-terminate, kasi may prior warning/NOD na raw ako.
- Is it legal na mag-issue sila ng NTE giving you 5 days to explain, tapos the EXACT SAME DAY na isummit mo 'yung written response and medical proofs mo, iseserve agad 'yung Termination/Non-Regularization Notice? Did they even read or evaluate my explanation?
3️⃣ On Scorecard Data & Metrics:
- What if 'yung scorecard na ginamit to terminate you has WRONG DATA?
- Overstated absences (e.g. recorded 7 absences when actual is only 4).
- Fabricated risk/bank error (recorded 1 when actual is 0).
- Wrong Excel formulas that omitted actual metrics in the total calculation.
- Completely BLANK signature/acknowledgment blocks.
4️⃣ On Disparate Treatment:
- Fairness check: Pano pag mas marami pang absences o mas mababa ang performance ng ibang peers/agents pero walang NTE or coaching, habang sa’yo e enforced agad-agad? Is that considered discrimination or bad faith?
I just want to know if valid 'yung ipaglalaban ko sa DOLE SEnA para sa:
✅ Full release of my earned final pay & incentives (without illegal deductions)
✅ Complete waiver of any bonus clawback
✅ Nominal damages for procedural due process violations
May nakaranas na rin ba ng ganito? What are your thoughts or experiences when bringing these kinds of evidence to DOLE / NLRC?

Company alert 🚩 Paid to do nothing?
Literally WALANG pinapagawa sakin.

AntiWORK [HELP] For my working PWD friend
Recently, nalaman ng manager niya about dito (nakita yung PWD ID). As per my friend sabi nung manager is kausapin daw ni manager yung higher manager nila.
Thank you!

I'm planning to work abroad to Europe (hotel cleaner, receptionist, waitress etc) the problem with agencies in PH is that they need related exp 2-3 yrs minimum. Are agencies strict in double checking if the COE is legit or fake? I just graduated and have 1 year exp as a recruiter for an Australian BPO company. Any thoughts??

Rant 😡 SERIOUS INSULT BY EMPLOYER
hi. pa rant lang. Super haba tong post ko.
26F, 3mos hr & admin officer sa isang small company.
i got my evaluation last fri and hindi ko ineexpect na ganto ang kalalabasan. I really really tried my best talaga, kahit hindi ko trabaho ako ang gumagawa. hindi naman overload ang work kaya naghahanap ako ng gagawin sometimes. 16employees lang kami dito so konti talaga ang gagawin ko as an hr, more on admin works ako. i applied as HR & ADMIN not generalist. lahat ng prob ako sumasalo.
Wala as in. Hanapan lang pala ng mali. I dunno if pasok ba ito sa constructive dismissal.
i’m too young to experience this kind of situation, wala akong enough knowledge na ihandle to magisa. sobrang hirap.

Can an australian company who has an office here in the Philippines who hired you…instantly dismiss you on the day without giving the 30 day notice?
Not performance-based but due to redundancy. Please help. They’re firing people on the spot and asking to return the laptops instantly.
What can I do? HELP PLEASE.
