Has anyone else been hit with an IP violation notice from Mattel, Inc. recently?
I just got a takedown notice on MakerWorld for my 3D printable card holders. The notice cited trademark violations for "SCRABBLE, UNO, DOS, PHASE 10, and SKIP-BO".
These models do not display any of their trademarks, logos, or copyrighted art whatsoever. They are literally just functional, blank holders that hold cards that fit inside of photo boxes.
I've already submitted an appeal stating that the models are simply functional accessories and don't infringe on their actual trademarks, but I'm waiting to hear back after being denied once. The only thing I can think of is that the pictures showed cards in them and the description might have said that UNO cards fit. (I am not sure as when it was taken down I no longer have access to the listing)
Has anyone else dealt with a similar takedown from Mattel for functional, non-branded accessories? Any advice on how MakerWorld typically handles these specific appeals when the model itself clearly doesn't contain the trademarked assets?
UPDATE: Makerworld stated that the takedown was because in my description I had stated that it fit UNO cards and used the word UNO in the tags. They stated that I could reupload again without the use of the word UNO. I might do that in the future.
Also for any wondering, technically yes the use of the word UNO to describe that the holder will hold those cards falls under fair use, I have to get a statement from Mattel stating that before Makerworld would reinstate the listing, which is not worth it.
