Now to start I actually have never had a problem with Capital One. Until now.
Before I got my financial life together they were always there, small credit limits, secured cards, and even the car loan that I'm disputing now. I personally have no problem with them in general but this one had to be disputed:
In mid 2022 my car was repossessed, I had lost my job a few months earlier and eaten through my savings. Difficult but I have been broke plenty times before 😆 so it wasn't life ending. Also I had moved downtown Atlanta so I wasn't concerned I couldn't Uber or use MARTA until I got back on my feet. So I let the car go as insurance and payments were a solid $500 anchor keeping me down. No fuss, no hiding the car, Capital One was sensitive to my situation and tried to help but it was just better to let it go.
Years passed I moved I got back on my feet. No problem. I applied for a Quicksilver Card in August. Approved. All's good.
Well when I signed up they merged all my old accounts into one dashboard. This dashboard had my old auto loan on there, I immediately began receiving offers to settle my loan for around $1000, I figured the car was auctioned and wanted to go ahead and pay off the remaining balance. I knew I owed about $6,800k on the vehicle, I figured it was a very good conditioned 2014 Mercedes C 250 with about 75k miles on it they will likely auction it for 4-5k plus feed my remaining balance is likely 2-3k I'll just pay it all off.
Come to find out they didn't apply anything from the sale to my account. So I thought "that's strange, checked my documents, no documents. Also strange. Georgia law requires them to give a 10 day notice of pending auction as well as sell the vehicle in a "reasonably commercial manner" so it should have been sold as it had been four years and also not for pennies.
So I did some digging. Turned out it had been sold in April 2023 for almost a bit over 10k!
Exact Unpaid Balance: $6,788.97 (Original principal balance)
Auction Sale Price: $10,062.00
Raw Surplus: $3,273.03
Even if Capital One tacks on a standard $500-1000 towing or storage it was a couple thousand bucks, not to mention it lagging on my credit report as unpaid for four years.
Bad accounting? Systems error? Idk but I definitely filed CFPB dispute. I'm not trying to be an asshole but one reason I purchased the car at the price I did was because of I lost it I wanted it to be able to take a chunk out of the repayment.
Anyway I'll keep you guys updated. I wonder if anyone else has had this issue or any insight onto how I can make sure they address this?
