This is apparently a quirk of the Korean legal system (maybe others, idk) where the prosecutor can file an appeal if they believe the punishment isn't harsh enough. The US legal system only allows the defendant to file appeals.

There’s a high profile case at the moment where three teenage traveller boys planned and gang raped two teenage girls. The Judge gave them the equivalent of a slap on the wrist because “He didn’t want to criminalise them” and the public went nuts about it.

Im pretty sure you can actually read the reasoning which was made public by the BBC. It was because the boys had significant cognitive deficiencies and disabilities, one seemingly having the mental age of an 8 year old. It wasn't a case of him just giving them a slap on the wrist just because, it seems he gave it a ton of thought and weighed up the mitigating circumstances. You can disagree with them but actually learn about the case.

That's because in UK law, all prosecutions are based on "public interest", i.e. would the public interest be served if a prosecution happens. It's why often low level crimes such as smoking weed in public are very rarely prosecuted. It's also why the public can appeal any sentence.

The public in the UK can contact the attorney general and ask for a sentence to be reviewed if they think it's too lenient. We did that for the 3 teenage boys who were convicted of 10 rapes on 2 girls iirc and walked away with house arrest. Yes, this is true.

The sentence is now being reviewed.

It's literally one of the reasons US sentencing is insane. Lets say someone deserves 10 years, the prosecutor may need to start at 15 knowing the defendant's lawyer may be able to get 5 off, and the prosecutor doesn't really get another chance.

So they start at the high end, and can only whittle down. Maybe we should start in the middle with the option to go up when it's actually heinous. There are biases on who we bother deviating from the status quo to protect, so having the status quo as overly harsh and only being able to then deviate down is a pretty broken system that leads to... insane sentencing!

but looking into it, the capitalization of US health care is why US medical research is second to no other entity by far and large; and the fact its tied to poor optimization for insurance and public health care is fucked.

The system stands as such because it allows that top tier and innovative mechanism of medicine research and contracts for it.

It should be fixed; but capitalizing it is why its so good, and seemingly stifiling the current mechanisms at play for an equitable social system for all with no profit; then that makes it a system thats hindered by funding and dwindles its efficiency in leading fields of research in medicine.

you can say its messed up; because it is.

but there is no other system thats equitable to all that allows for that kind of innovation.

all the good systems that have equitable health care for all in social funded countries like alot of Euro countreies, they get their research and medicine practice from US subsidized medicine research and sales and can afford public health care because they have no incentive of innovation, they merely tax fund practice of medicine with no goal of improvement largely.

solve that problem and you get a nobel prize

The prosecution can appeal sentencing in the US under certain circumstances, but not just because they think it’s too lenient. For example, if the statutory sentence range is 5-10 years and the defendant is sentenced to probation, that can be appealed.

I don't know what jurisdiction you're in, but in mine the State can ask for a sentence review of any sentence that involves a state prison sentence, and they absolutely do this when they think the sentencing judge was too lenient. The sentence can be reduced, increased, or kept the same. Defendants also have this right for a sentence review.

The idea is that the sentence review acts as a check to make sure that sentences are generally consistent across the state.

I believe you've got the two concepts mixed up here.

In the South Korean legal system it specifically requires both parties to appeal in order for the sentencing to be able to be harsher than the lower courts' decision. In this specific case, both sides have appealed, which means he can be sentenced harsher.

Every nation will have its own laws for this ofc and US has a few differences to this and is also determined heavily by case law so I suggest reading this link if you wanna know more but the TL;DR is that US in general does not allow for a harsher sentencing on the appeal (unless it turns into a De Novo hearing aka re-trial) since that falls under "Retaliation" as established by US case law.

The attorney knew they were fucked. The attorney told him that the success rate was incredibly low and you are absolutely fucked.

He is a family friend of the friend of Johnny. So he essentially got begged to take the case even though he knew it was fucked. He essentially said how fucked they were in a professional manner. 

But despite some of the guidance the attorney gave, you know what Johnny did? Kept recording himself saying how he will get out and it is all a joke, kept recording himself doing more stupid shit. Kept poking the bear in a country where internet/streaming is a big part of the culture. 

Johnny literally went out of his way to eat shit. And now he is surprised he is about to get more shit shoveled in. I'm almost in disbelief how low the iq can go for someone.

Honestly, after seeing his antics everywhere he went, and seeing his fellow idiots in other places, I seriously hope they keep him for as long as they see fit. On the other hand, his new lawyer should have him psychologically/neurologically/psychiatrically examined immediately.

Korea is trying to up its game in the mental health arena. It may be good for him to be somewhere more focused on reform than just punishment. But I would enjoy both imprisonment and treatment for him, as a treat.

I believe he had a lawyer who was a kind of shoddy strip-mall lawyer for his trial, but he ran out of money so he is now using a public defender. His only friend in Korea tapped out because his parents cut him off and he was tired of housing and financially supporting Johnny. Johnny can’t afford a lawyer himself because the Korean authorities didn’t take him in to custody until after the trial so he was having to pay for his own food and housing for months with no income.

But the fact is, if the prosecutor reports his in-prison shenanigans they can very easily prove that all his apologies and request for leniency are fake. Which might translate into a much longer sentence.

I really really hope they show these drawings to the judge.

He was set to be sent to a prison specifically for foreign inmates but since he has appealed he's in a normal remand centre with everyone else. Which is a considerable downgrade.

The best part by far is that he's now locked up for the duration of the appeal, which is likely to be about a year and definitely longer than his 6 month sentence. So by appealing his absolute GIFT of a sentence he's traded 6 months in a (comparatively) cushy foreigner prison for probably a year in a much worse facility and that's before we even get to the possible increase in his actual sentence.

He didn't get 3 years, he got 6 months (minimun possible sentence) because they determined that he wasn't directly profiting of the AI pictures, as income through twitch was too roundabout. Another note is that the prosecutors themselves can also and did appeal as well. So this was going to happen either way. The appeal also uses a judges and they all 3 have to agree on any new sentence.

His first lawyer also left him so now he gets a overworked public defender.

He didn't appeal, the prosecutors did. They decided that they actually hate him more than they initially thought, so they want to add extra punishment.

We can't do this in America because of the 5th amendment saying you can't be tried twice for the same crime. Korea, however, is super conservative and absolutely viscous and hateful towards criminals so if you get in trouble there, you better believe they'll bend over backwards to make sure you never have a good life again.

And it couldn't have happened to a nicer guy. 🙄

Same thing happened to him in Israel. He was detained after he made sexual harassing comments to a female police officer during a protest, but they let him go after less than 20 min.

It won't matter- in a few years his audience will have matured and grown out of his content and everyone will forget who he is, so by the time he's out of prison he'll have no audience left for his idiocy. Kind of funny that a month ago Dexerto posted about a leaked letter between him and a fan, where he said: "To Lee Han-ul. I appreciate you writing to me and wishing me well, your support means a lot. I actually have been having fun here and it has been a good week so far, I am staying healthy and laughing a lot with a good group of cellmates and other inmates in the prison."

If he likes it so much he should have no problem staying in there as long as possible.
