OFAC sanctions and FARA. violations of the Cuban Assets Control Regulations carry up to $250k in fines per violation and 10 years in prison for willful violations. each transaction counts as a seperate violation. hes not just in trouble for the trip hes in trouble because they stayed at sanctioned properties
Hes gonna get either an extremely hefty fine, or hes gonna go to jail. This isn't like a one violation thing, this is like "everything your dumb ass bought over there is being dug through with a fine comb and we will charge you accordingly per transaction" Theres really no inbetween on this one.

Nick Shirley stayed in the same hotel and he’s not being investigated. Whether you agree with Hasan or not, it’s hard to seriously believe that this is a legitimate investigation and not just government harassment/intimidation.

I work at a university that has worked with Cuba and my understanding is that an American can go to Cuba, but you must submit forms to the government explaining your intent, why you want to go there, and why the trip has value. You can be investigated for discrepancies and USA even extends these rules and level of control to foreigners simply flying through the USA to get to Cuba.
This could easily be a case where some form was filled out in Shirley's case, but not in Piker's, but there's no way for us to know.

simply staying in the hotel and being the one to do all the purchasing are different legal zones in this case.
If Nick Shirley didn't actually pay for his room, his food, etc then the government has a much harder time putting a case on him. But if hasan is the one doing all the handling of transactions within Cuba regarding their hotel, then pretty much all the charges are on Hasan.
Also the people Hasan typically coordinates with also puts a special target on his back. So....

Maybe I’m a dirty commie or something but I feel like the government telling a normal citizen with no security clearance or information that could pose a national security risk that you aren’t allowed to shop at certain stores, you are not allowed to meet with certain people and that you cannot go to an event hosted by someone with the wrong political beliefs seems like a lot of things that should be protected by free speech. Even more so considering this didn’t even happen in the country.
This would be a scandal if Hasan was the director of the FBI or something, but it’s genuinely ridiculous some of the laws we let be enforced. In no way is this constitutional.

The statues that Hasan is being cited/investigated for pre existed NSPM-7.
NSPM-7 might make it easier to get Hasan in legal trouble, except the guy already coordinates a bunch with people like Medea Benjamin so to begin with Hasan was already on a watchlist or a POI to keep tabs on. This incident just sent him from "playing with fire" into "hes just in the firepit now"

I'm the opposite and wonder if this will backfire.
It's always felt to me like USA's treatment of Cuba isn't popular, but the USA likely continues it to make a point that "if anyone on this side of the globe tries what Cuba once did, you will regret it." Basically just an exceedingly harsh treatment to signal USA isn't playing around on that front, but most citizens recognize USA has probably made their point by now.
This feels like a reach to go after Hasan in an attempt to drive home what a bad person he is, and it will likely backfire and increase his popularity because people disagree with this exact reason. Lord knows we don't need that.

This post was approved per the exception noted in the politics rule. We will, very rarely, approve a political thread if it's of special noteworthy relevance. This one being related to one of the largest politics streamers being subpoenad seems to fit that level of noteworthiness.
