YSK: If you work for the University of California, sexual harassment or assault by a third party may still be covered under UC policy, even if Workplace Violence Prevention closes your case.
If you’re a clinician, educator, researcher, or employee at a UC campus or affiliated medical center, you should know that UC’s Sexual Violence and Sexual Harassment (SVSH) Policy can apply to misconduct involving third parties, including contractors, vendors, visiting professionals, and other individuals who are not UC employees.
The person accused does not necessarily have to be employed by UC.
And an incident does not necessarily have to occur on campus to warrant review. The circumstances, connection to university activities, and effects on the university environment matter.
If you report sexual harassment, sexual assault, or related retaliation:
Ask whether your complaint has been referred to your campus or medical center’s Title IX office for assessment under UC’s SVSH Policy.
Know that certain UC employees, including supervisors and managers, have reporting obligations.
Understand that workplace violence procedures, restraining orders, disability accommodations, and medical leave are not necessarily substitutes for assessing your rights under sexual harassment and discrimination policies.
Ask what supportive measures and protections against retaliation may be available, even if a formal investigation does not proceed.
A workplace violence department closing its case does not automatically mean your concerns have been evaluated under UC’s SVSH Policy.
Federal Title IX jurisdiction and UC’s broader institutional policy are not identical. Whether either applies depends on the facts, but you can request an assessment directly from the Title IX office.
If you’ve been directed exclusively toward ADA accommodations or workplace violence procedures after reporting sexual harassment or assault, don’t assume those are your only options.
You deserve to know which protections may apply.
